Tax Residency

Tax Residency is the country (or countries) that has the legal right to tax your worldwide income, determined by factors like days physically present, permanent home location, and center of vital interests, and it can differ from your citizenship or passport country.

What is Tax Residency? Tax Residency is the country (or countries) that has the legal right to tax your worldwide income, determined by factors like days physically present, permanent home location, and center of vital interests, and it can differ from your citizenship or passport country. Most countries use a version of the 183-Day Rule as the primary test, but permanent home, family ties, and economic center of life can also trigger residency even below 183 days.

Worked example: a remote worker spends 120 days in Country A, 100 days in Country B, and 145 days traveling elsewhere in a calendar year. Neither A nor B hits 183 days alone, but Country A may still claim tax residency if it is where the worker keeps a lease, a driver’s license, and a bank account, since “center of vital interests” tests look beyond day counts. Without deliberately establishing residency somewhere, a nomad risks being claimed by their prior home country by default.

Dual tax residency claims by two countries are resolved by a bilateral Tax Treaty when one exists. Because rules vary by country and change over time, nomads pursuing Expat FIRE or long-term Geo-Arbitrage should confirm current residency rules with a cross-border tax advisor rather than assuming any single rule of thumb applies everywhere.
