Terms of Service

These Terms of Service ("Terms") govern your use of the IndepAI platform at indepai.app (the "Service") operated by Michał Wiatr, operating as IndepAI ("IndepAI", "we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. The Service

IndepAI provides AI-powered financial planning tools for digital nomads, including FI Score calculations, geo-arbitrage comparisons, tax optimization modeling, and AI financial coaching. The Service enables account creation via email or third-party providers such as Google. The Service is provided for informational and educational purposes only.

2. Not Financial Advice

IndepAI does NOT provide financial, tax, legal, or investment advice. All calculations, projections, and AI-generated recommendations are for informational purposes only and should not be relied upon as professional advice. Always consult qualified financial advisors, tax professionals, and legal counsel before making financial decisions. We are not liable for any financial decisions made based on the Service.

3. User Accounts

You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials. You must be at least 18 years old to use the Service. One person or entity may not maintain more than one account.

4. Third-Party Authentication

The Service offers sign-in via third-party authentication providers, including Google. By using Google Sign-In, you agree to Google's Terms of Service and Privacy Policy. IndepAI's use and transfer of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements. You may revoke IndepAI's access to your Google account at any time via your Google Account settings. IndepAI is not affiliated with, endorsed by, or sponsored by Google LLC or any of its subsidiaries.

5. Subscriptions & Payments

Some features require a paid subscription. Payments are processed securely via Stripe. Subscriptions auto-renew unless cancelled before the renewal date. Refunds are available within 14 days of initial purchase if you have not substantially used paid features. You can manage your subscription and cancel at any time through the billing settings.

6. Acceptable Use

You agree not to: use the Service for any illegal purpose; attempt to gain unauthorized access to the Service or its systems; reverse engineer, decompile, or disassemble any part of the Service; use automated tools to scrape or extract data; share your account credentials with others; upload malicious content or attempt to compromise system security.

7. Intellectual Property

The Service, including its design, code, algorithms, and content, is owned by Michał Wiatr, operating as IndepAI and protected by intellectual property laws. You retain ownership of any financial data you provide. By using the Service, you grant us a limited license to process your data solely to provide the Service.

8. Data Accuracy

While we strive for accuracy, financial data (cost-of-living indices, tax rates, city data) may contain errors or become outdated. We make no warranties about the accuracy, completeness, or timeliness of any data provided through the Service.

9. Limitation of Liability

To the maximum extent permitted by law, IndepAI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or financial losses arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

10. Termination

We may suspend or terminate your account if you violate these Terms. You may delete your account at any time. Upon termination, we will delete your personal data in accordance with our Privacy Policy.

11. Governing Law

These Terms are governed by the laws of Poland. Any disputes shall be resolved in the courts of Krakow, Poland, unless you are a consumer in the EU, in which case you may bring proceedings in your country of residence.

12. API Terms Compliance

To the extent the Service accesses Google APIs, you agree that IndepAI will comply with the Google API Services User Data Policy. In the event of any conflict between these Terms and Google's Limited Use requirements, Google's Limited Use requirements shall prevail with respect to Google user data.

13. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or a notice on the Service at least 30 days before they take effect. Continued use after changes constitutes acceptance.

Right of Withdrawal (Consumers)

If you are a consumer in the EU, you have the right to withdraw from a paid subscription within 14 days of concluding the contract, without giving a reason, by contacting us at support@indepai.app. Because the Service delivers digital content and access immediately, at checkout you expressly request immediate provision and acknowledge that you thereby lose the right of withdrawal once provision has begun, as permitted by applicable consumer law. Where you have not given this consent, the 14-day right applies and we will refund your payment using the same payment method you used.

Complaints

If you have a complaint about the Service, contact us at support@indepai.app with a description of the issue, your account email, and the resolution you expect. We will confirm receipt and respond within 14 days. EU consumers may also use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr/.

Community Moderation

The Service includes community features where members publish content, including city reports, city feedback, posts, events, and circles. We moderate that content. Content may be removed, and an account may be warned or restricted, where the content breaches the Acceptable Use section above or applicable law.

Any signed-in member can report content or another member from within the Service. A report must state a reason. The available reasons are harassment, stalking or location misuse, threats of violence, doxxing, scam or fraud, hate or abuse, sexual solicitation, impersonation, unsafe event, illegal advice, spam, and other, which requires you to describe the problem. You receive a reference for every report you file, and you can see the status of your own reports, which is received, under review, actioned, or dismissed, together with the action taken once the case closes. Reports are confidential: the member you report is not told who reported them, and you are not shown their account details. We do not currently publish a fixed deadline for handling reports.

Reports of stalking or location misuse, threats of violence, doxxing, and unsafe events are routed to a separate queue and reviewed by a person ahead of other reports. IndepAI does not report anything to any authority automatically. Michał Wiatr, operating as IndepAI, is responsible for moderation and for these escalations.

Every moderation decision is recorded as a statement of reasons. The statement records the action taken, which is one of no action, content removed, content kept, account warned, account restricted, or escalated; the rule or legal basis for the action; a summary of the facts it relies on; the territory it applies to and whether it is permanent or temporary, where those are relevant; whether automated means were used in reaching it; and the date. A recorded statement cannot be edited or deleted. If a decision is later corrected, a new statement is recorded that supersedes the earlier one, and the earlier one stays in the record. When a decision concerns you or your content, you receive a notification and can read the full statement under Moderation decisions in your dashboard.

You can contest a decision from that same screen. One request can be submitted per decision. The request is recorded on the decision and reviewed by a person, and the decision is not altered by the request itself. Where the review changes the outcome, a new statement of reasons is recorded that supersedes the original. The decision shows your request as appeal requested, and as appeal resolved once the review closes. Contesting a decision here does not affect your right to bring the matter before a court or before the authority responsible for digital services in your country of residence.

Point of Contact under the Digital Services Act

The Service is operated by Michał Wiatr, a sole proprietorship registered in Poland, at the address given in the Legal Notice. IndepAI is therefore established in the European Union, and does not appoint a legal representative under Article 13 of Regulation (EU) 2022/2065, the Digital Services Act.

The single point of contact for the authorities of the Member States, the European Commission, and the European Board for Digital Services, under Article 11 of that Regulation, is hello@indepai.app. Putting "DSA" in the subject line helps route the message to the person responsible for moderation, but is not a condition for it to be handled. Messages sent to that address are read and answered by a person.

The single point of contact for users, under Article 12 of that Regulation, is the same address, hello@indepai.app. You may instead write to support@indepai.app, or use the report and appeal screens inside the Service described in the Community Moderation section above. None of these routes relies solely on automated tools.

You can communicate with either point of contact in Polish or in English. Polish is an official language of Poland, where IndepAI is established. We do not offer the points of contact in the other languages in which parts of the Service are published, because we cannot handle correspondence in them.

IndepAI is a micro enterprise within the meaning of Commission Recommendation 2003/361/EC. Under Article 19 of that Regulation, the additional obligations on providers of online platforms set out in Section 3 of Chapter III do not apply to it. IndepAI therefore does not operate a separate internal complaint-handling system under Article 20, and has not designated an out-of-court dispute settlement body under Article 21. The routes described in the Community Moderation and Complaints sections remain available, as does your right to bring the matter before a court or before the authority responsible for digital services in your country of residence.
